Legal Question in Wills and Trusts in New Jersey

Probate Issue

My Grandmother who had no legs and was in a nursing home on Medicaid passed away in July 06. My mother-her daughter passed away in Nov 04 and her husband passed away in March 04. She had 10 siblings. One of her brother's passed away in Jan 05. They could not find his will so it went to probate. I was the power of attorney for my Grandmother at the time. I signed any papers I received prtaining to my Great-Uncles Estate. My grandmother wanted the money to go to her nephew who became the admistrator of her brother's estate. Since my grandmother has passed away-she had no estate-the estate of my uncle is being finished. My grandmother is due over $20,000-I do not want the Satte of NJ to receive this-I was hoping this could be signed over to my cousin or left to my grandmother's surviving son. What do I need to do to prevent the state from taking the money-I have not signed anything-I am told I need to go to the surrogates court to sign a paper there. Please advise.

Re: Probate Issue

I was wondering why you think the money is escheating to the estate?
