probate a will

How can I find out if my dads will was probated and if it was does his property autimatically get put in our names or do we have to file for that.

You can call the Surrogate Court in the County where your dad lived at the time of his death.Any will would have to be filed (i.e. "probated") there. Any property is not automatically transferred and you would probably need an attorney to help with that. If you need any other help, please call my office for an appointment.

You can contact the Surrogate's court in the county where your father lived to find out if his Will was probated.

No, your father's assets don't 'automatically get put into your names'...Based on your question, I suggest you hire an experienced attorney to help you with this as it may be complicated [especially if a lot of time has passed since your father died].
