Legal Question in Wills and Trusts in New Jersey

Refunding Bond and Release

I have been named Executer, did all the accounting, sent out a refunding bond and release form. My one sibling of 9 refuses to sign off. What do we do?

Re: Refunding Bond and Release

If one sibling refuses to sign off on the estate accounting, you are at an impass to make the final distribution.

Since you have already prepared the estate accounting, my advice is to file a Complaint in court, seeking the judge's approval of the accounting, including the proposed distribution.

If the court accepts the accounting and the proposed distribution, you will be discharged [i.e. a beneficiary can't sue you later] and you can proceed with the distribution without the need for the objecting sibling to sign anything.

You will need an attorney to help you with the court filing.
