Legal Question in Wills and Trusts in New Jersey
survivng spouse auto title of ownership
Two months prior to my father passing away he obtained an auto loan in his name only from PNC bank. Because he was 75 he was not eligible for the life insurance on the loan. I have been paying the loan payments for the last nine months so that she may keep the car however I have been experiencing difficulty with PNC in adding my mother to the title of the car so that it can be registered in her name now. I am not able to obtain a loan myself at this time to payoff the loan that is in his name, however she can through a local credit union. However, PNC Bank will not allow any one to be added to the title in order for this to occur. It is my understanding that my brother who is the executor of my father's estate can assign ownership of title to her as surviving spouse. We go back & forth with PNC as to whether this can be done. A friend of mine @ Ford Motor Credit told me it can with Form C5 and a short certificate from my brother. DMV told me in can be done & gave me a form to fax to PNC. Again, PNC refuses to cooperate unless the loan is paid in full. As I said my mother can only obtain a loan thru the credit union as she has absolutely no credit history due to everything being in Dad's name. PNC denied her a loan.

Why don't you have the attorney who is handling your father's Estate deal with this?
If you do not have one, get one.
