Legal Question in Wills and Trusts in New Jersey

Transfer of inheritance tax form

I have been investigating my fathers estate. He passed away almost 5 years ago and i am making great progress uncovering alot of the truth. Could you please tell me if the banks keep records of a L-8 form and if so for how long? Also where would there be a copy of a refunding bond be kept? Thank you

Re: Transfer of inheritance tax form

I do not know of any general rule on how long a bank must retain a copy of an L-8 form. I suggest if you know which bank is involved, that you make a written request for a copy (although they would not be required to provide you with this information and in fact, may not have any record of it at all at this point).

The refunding bond [I assume you or the other beneficiaries signed it] would either be kept with the executor's personal estate records; with the attorney who prepared it; or if it was filed with the Surrogate's office, you can obtian a copy there.

Just curious but I'm wondering why you are investigating "the truth" about your father's estate five (5) years after his death? You may have some serious statute of limitations problems if you want to pursue a claim against the estate or the executor at this point in time.
