Legal Question in Wills and Trusts in New Jersey

trust fund

When the grandmother died she left a trust

fund for three of her grandchildren that

when they became 18 they would receive their

share of the fund. When the first child

reached the age she was refused her money.

The guardian of the trust said the money

was used to pay lawyers fees because the

will was contested. Can a childrens trust

fund be used this way? What is the best

way to go? The family does not have the

money to fight this in court, because the

father died two years ago. The daughter needs

this to help pay for her college.

Re: trust fund

This question cannot really be answered without knowing alot about the history of the case. What happened after the grandmother died? The will was likely probated since you mentioned litigation. However, that would have likely led to some Court Order. What did the Order say? There are alot of unanswered questions. I would be happy to discuss them with you if you want to call my office at 609-546-8010. Good luck!
