Will, elder law

My husband is brain injured and is on medication. How do I protect my children if I should decease first; since both our names are on the mortgage?

You need to make an appointment with an attorney that handles Wills and Trusts to determine which documents need to be prepared for you. It is impossible to answer this question without first meeting with an attorney who can collect all important information from you to make sure you and your children are protected. It is good that you are looking at this now as it is very important to plan about either of your passing in advance. Good luck.
