Legal Question in Wills and Trusts in New Jersey

will

A relative has been declared incapicitated. Her husband died in 2003. He left a will. Executors were their 2 children. One child died in 2005. We think the other child misused her mother's funds. A copy of her husbands will did not include where his investments were/are. It mentions a trust for his wife, but no info was included. How can we secure this info so we know where to begin to trace her money and secure her future? I was the petitioner for her and her daughter was removed as POA in June, 2008. A temporary guardian has been declared.

Re: will

Who is the attorney handling the case? Generally, I do not give advice where the person is already receiving counsel, but rather direct that person to confront the lawyer to get their answers. Or fire the lawyer if you feel something is fishy...

If you need to hire counsel, I'd be happy to interview you by phone. Under the right circumstances, I would be willing to travel to assist your relative.

Re: will

I certainly can not help you, since you are located in central Jersey, and I am just outside New York City.

You absolutely positively need a good estate attorney who also handles estate litigation. Find one, and hire him/her.

Re: will

It looks from the zip code like this is an Ocean County matter. If you go to court, you will learn that the rules in Ocean County are a little "different" than eveywhere else in New Jersey. Good luck.
