Legal Question in Wills and Trusts in New Jersey

Will...

My wife and I was included of the will of our employer who died last oct 14, 2008... The lawyer told us before that it will only take less than 6 months to get our share, but when my wife called them after 6 months they told us to wait another 3 months for the taxes and eveything... Do we need a lawyer to assist us with this matter? Thank you and have a good day...

Depending on the size and complexity of the Estate, this is not an unusual delay. whether you need an attorney depends on a number of factors such as whether you are receiving a fixed amount or a percentage share. So you would be best served by a preliminary consultation with an attorney who can better advise you about this after a more comprehensive review.

Maybe, but probably not. As non-relatives and depending (A) on the size of the total estate and (B) how much you are to receive, the estate is probably subject to death taxes. The State is slow to make its final tax determination and this is what is probably holding up settlment of the estate. I suggest calling the attorney to verify that this is the problem and to get an estimate of how much longer it may take to resolve. If there are any problems, then retain your own attorney to assist you.
