How long does it take until probate steps in when there is no will?

Presuming there is a probate estate, someone needs to be appointed Administrartor to act on behalf of the estate. This is usually the closest surviving family member (spouse, chilkdren, parents, etc.).

If more than one person is eligible (e.g., multiple children), one or more can act and the others can renounce their appointment. Administration usually requires that the person appointed be bonded, which must be in place before the appointment is finalized. These steps can take some time, especially to get the proper bond, so 6-8 weeks is not unusual. Sometimes this takes longer. If you need more information or assistance, contact me directly
