Legal Question in Workers Comp in New Jersey

2 jobs; does it affect worker's comp?

I am currently working 2 jobs. My full-time job as a maintenance worker in a hospital caused me to tear a muscle in my elbow. My p/t job I work every weeknight as a clerical worker. I have been on workers comp sporadically and continued to work my p/t job because it requires no manual labor. I am being told by my f/t employer that I broke the law. Can I continue to work my p/t job even though my dr put me out of my f/t job because of the manual labor involved?

However, the law is that you are entitled to temporary disability payments from the WC carrier when you are temporarily "totally" disabled and under active medical care through an authorized treating physician. "Totally" disabled means what it sounds like - that you can't work either job while you collect temp. While this is probably not what you want to hear, we can explain more of the Workers Compensation system when you call us.

If you are collecting disability, then this means that you cannot work - period. If you are working even part time at a non-manual labor job, then you should not be collecting disability. The potential penalties would be a reimbursement to the workers compensation insurer of any money you received. However, if you tore a muscle, this is a serious injury and one that should result in a workers compensation permanent disability award to you.
