Legal Question in Workers Comp in New Jersey

are there caps on settlements

I fell at work and broke my femur. I am filing a workers comp case and everyone is telling me this is the wrong way to go b/c there is a cap on the settlement you can get for permanent disability. Is this true and should I also persue a pain and suffering case?

I'm glad that you contacted me because from what you wrote, everyone you spoke with has been giving you the wrong advice. If you fell at work and broke your femur, then your only recourse is through workers compensation. You cannot file a pain and suffering type lawsuit since there was no outside third party that caused your injury. And as to there being a cap on a workers compensation award, this is not really true either. Workers compensation awards are based on your actual injury and how it negatively affects your ability to work.To me it sounds like you have a very good workers compensation case and I would certainly like to discuss it with you in more detail. you must file a wc claim if you were injured on the job. You may havbe a third party complaint if there was negligence of another. I would need to know more specifices to advise you. The wc is governed by a chart for injuries.
