Legal Question in Workers Comp in New Jersey

contractor without workers compensation injured

If an independent contractor does not carry workers compensation and hurts his back while working at someone's home does he have to go through his own HMO insurance for benefits?

If you are the target of the contractor, get a lawyer.

If you are the contrator, shame on you for going after your customer.

Each case is unique, so I cannot give a specific answer covering the facts of your case. In general though if it is the contractor himself, and not one of his employees, that got hurt then he should use his own private health insurance. If he has employees, then he must have workers compensation insurance.
