Legal Question in Workers Comp in New Jersey

Am I covered?

I have several clients whom I have to visit during the day. I travel from one place to another using my own car. I am not getting reimbursed for the gas or the mileage. Two weeks ago traveling from one client to the next I have been involved in single car accident. The car started sliding on the slippery road and hit the trees. The ambulance brought me to the hospital emergency room where I spent about 5 hours and been released with the instructions to visit the doctor for follow-up observation. Within 30 min of accident I reported about it to my supervisor. I have no medical insurance and I wanted to initiate the Workers� Comp claim as soon as possible to make sure that I can get medical help covered. Have been told by my employer that I am not eligible for Workers� Comp because the injuries happen while I was not at place of work. I actually don�t know if they notified the respective athorities about the accident. Please let me know if I am eligible for coverage under Workers� Comp. What should I do to start the process? Whom the doctors and hospitals should send the bills to?

If you were driving in the course of your employment, like going to visit clients, then you are covered under workers compensation. You should ask your boss to contact the workers compensation carrier so you can be evaluated, and treated, by a workers compensaiton authorized doctor. This would be at no cost to you. If you are unable to work and the workers compensation doctor puts you out of work for at least eight days straight, then you are also entitled to recieve temporary disability payments for the time you were out. Finally, when you are all done treating, we can go to court and try to get you an award (monetary settlement) through workers compensation for your injuries. First of all, your employer is Wrong. This is a compensable accident. In order to handle this with the least amount of conflict, I would tell my boss I called Worker's Compensation in trenton and that you explained the situation to them.they told you this was definetely a Comp case.They said that since you were in the course of your employment, this has to go through your employer's Workers Compensation carrier. Tell the hospital and your doctor to submit the bills directly to your employer.
