Legal Question in Workers Comp in New Jersey

Hi. A door was slammed on my shoulder in 11/2008. I have gone to therapy for a while and recently (in 11/2009) gotten a cortisone shot. My MRI shows a torn rotator cuff with fluid building in there. I lost my job in Dec. As far as I know, the shot worked. But but that I am back to work, my shoulder hurts now more than ever. I am even experiencing pain all the way down my arm and into my hands. Not sure if the 2 are related. It is really affecting my work. I don�t know what to do. Will this increase the amount of my settlement? Also, my lawyer said that I can re-open this case later if it bothers me more. I think I would like to do that, but not with the same lawyer. Any suggestions? Please respond.

If you already have a lawyer and your case hasn't settled yet, it is too early to talk about re-opening your case with a new lawyer. The two year period begins to run when your last settlement check is received. Ask your lawyer for the details of what that will mean in your case. If you are completely dissatisfied with the settlement offer that may be given you in the future, you have the right to take your case to trial. Ask your lawyer about that as well. If he won't take your case to trial if you are unhappy with the settlement offer, at that time you can consider looking for a new lawyer as well.
