Legal Question in Workers Comp in New Jersey

flight attendant workers comp

the doctors claim that I need to lift 50 pounds over my head before they will release me to fly. Is that possible? That much weight for a flight attendant?

Re: flight attendant workers comp

That really depends on your job description as well as FAA regulations. There are minimum physical requirements for attendants due to safety issues, and the employer must follow them. Additionally, if they have their own rules that are rationally related to the employment, then it is enforceable.

I suggest that you check with your Union rep, your contract and your employment manual.

If none of these actually require this weight, then it may be possible to get you back to work sooner.

Our firm also handles worker's comp and we would be happy to discuss your rights further. I have had several clients who were flight attendants and have been successful in assisting them.

Best wishes.

I m sure that the doctor has specific guidelines that he has to follow and that is where he got the 50 pounds limit from. You can confirm this by referring to your employment manual. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail.
