FMLA vs Workerman's Comp

My husband has an open workman's comp claim open. The HR rep at his job mailed FMLA papers to him. She said the if the FMLA papers were not filled out in 15 days his case would be closed. My question is why does he have to fill out FMLA papers if he is already on workman's comp?

He shouldn't have to. If he is still too sick to work because of his workplace injury, then he should continue to receive temporary disability payments through workers compensation. If you don't have an attorney already I would ask that you contact me to discuss this matter. I am an attorney who has handled many cases similar to your husband's in various workers compensation courts throughout New Jersey in the past.
