Legal Question in Workers Comp in New Jersey

Health Benefits

My husband was on Worker's comp till 8/8/06. He was released on modified duty on 8/9/06 but his employer did not have light duty work for him. So he was told to go to his followup appt on 8/15 and see what the doctor said. Doctor released him on full duty 8/15. While being on w.c. he was given an opportunity for a second job which he accepted. That is why his w.c. paychecks ended on 8/8. He returned to work on 8/16 and after an arguement with his boss ( because he heard my husband had another job) my husband resigned that day. A month later I got a letter from our health benefits that the employer terminated the family health insurance as of 8/1/06 while he was still on worker's comp. Can they back date our insurance when we have proof that he was still out with an injury? And we were never given a cobra option. Now I have dr. bills for that 2 week period that haven't been paid. What can I do? Please Help!

Re: Health Benefits

I suggest that you find and hire an attorney who specializes only in worker's compensation law. There are many attorneys who do. I do not.

Good luck to you.
