Legal Question in Workers Comp in New Jersey

My husband was in a truck accident while on the job last year in May 2015. He went through Workers Comp through his employer and was receiving physical therapy. After only 2 months, his Worker's Comp insurance decided not to pay for anymore treatment and was cut off from Worker's Comp through his employer. He is still suffering from severe back and neck pain and was never medically cleared by his therapist. My husband sought out a lwayer to file a personal injury claim on the truck that hit him and also he is suing his former employer. It has been almost a year now and still his case is pending. His attorney sent him for Pain Management however, at his appointment, the front desk receptionist informed my husband that he dod not need to go for Pain Management. Ever since, he has been trying to get answers regarding his case and to no avail. My husband is getting very desperate and cannot find work, still suffering from back pain. How can we go about looking for another attorney to take over our case and if so, will he have to pay for new representation?

If you decide to switch lawyers, you will not pay any additional legal fee. The legal fee you would have paid one attorney will have to be split between the two attorneys with no additional cost to you.

Communication with your attorney is important. I recommend you schedule an appointment to discuss the questions you have and write them down and go through your list.

The attorney should be getting a medical opinion on what treatment is necessary and requesting that from the Workers Compensation carrier. If the carrier does not provide treatment voluntarily, your attorney should be filing a Motion for Medical and Temporary Benefits (in New Jersey cases) and seeking an order compelling same.

The time period of resolving cases can be years so I'm not too concerned with a passage of one year. I am more concerned with the lack of medical treatment.
