Legal Question in Workers Comp in New Jersey

Insurance Co. Not replying for a permanency exam

I was injured in March 2005, tore a bi-lateral inguinal hernia while lifting heavy objects. Filed a permanency exam. Got checked by my attorney's doctor within a few months. it has been over two years and the insurance co. has not responded for their permanency exam. My attorney offers no anwers and is giving the run-around. Is there a limitation to the time an insurance co. can take? Should I change my current representation? Please help

Unfortunately, often it takes several years for a workers comp case to resolve. However, your attorney shoud be able to give you some sense of what is going on and when the case is likely to come to resolution. If he does not, then that may be a reason to seek alternate counsel.

If he is unable to answer your questions or at least let you know why he cannot, then perhaps you want to change.

I always get a little concerned when a lawyer dodges a client's phone calls, won't give any status on a case, and a long time has passed since any action has been taken on a case.
