Legal Question in Workers Comp in New Jersey
Knee pain related to work
I am in chronic pain, which is caused by my job as a deliveryman. About three months ago I underwent knee replacement surgery. Now that Im back at work my knee is hurting constantly. The pain is the result of walking everyday and carrying a heavy sack on my shoulder. I asked the boss if I could be transferred to truck duty where I wouldnt have to walk or carry the sack. My boss just ignored me and I am still in constant pain. As of now I feel that my knee is getting worse and could possibly be damaged if I continue to work as they expect me to. Is there anything I can do about this situation?

It sounds like you have a legitimate workers compensation claim and it also sounds like your employer is not properly treating this as such. Yes there is something you can do about the situation. You are entitled to the proper treatment for work-related injuries through your employer. If you are still in constant pain, your employer should send you to a doctor to evaluate you and decide what treatment is necessary and evaluatie whether you can return to work. If a doctor determines you cannot work, you may be able to recieve temporary disability benefits while off from work. In your situation, you also may be able to collect for the permanency of your work-related injuries.
