Legal Question in Workers Comp in New Jersey
How Long Does an Employer Have to Hold my Job?
I am scheduled for surgery on my wrists, the first one to take place 12/13, the 2nd approx. 3 weeks later. I am being covered by worker's comp. I've had another serious health issue occur, which if hospitalized and a surgery required, would be an additional 6 weeks out of work on disability. What I need to know is in the state of New Jersey, how long is an employer required to hold your job for a worker's comp issue and how long for a disability issue? Are they counted as seperate instances, or is the time accumulative?

Re: How Long Does an Employer Have to Hold my Job?
New Jerswey is what is called an "at will employment" state. Unless you are protected by a union contract or some other form of employment contract, then your employer does not have to hold your job for you at all. The needs of the business are paramount. For as long as the workers comp doctor keeps you out of work you will still receive workers comp temporary disability payments, and if you are collecting a different type of disability for a different injury you can collect that for as long as the disability plan allows under your circimstances. However when the workers comp and other disability run out, if your employer does not have any job available for you then you are out of luck from that end. The workers compensation hand injury can result in a monetary settlement for you though, if it is filed properly. That is something that I would like to talk to you about now. I am an attorney who has handled many cases similar to yours in various workers compensation courts in New Jersey in the past. I would like to discuss your case with you in more detail. Please contact me so we can talk about what I can do to help you in this matter. There is never any charge for simply talking to me about a case. Thank you.
