Legal Question in Workers Comp in New Jersey

I work for a SouthAfrican company.While there on biz in DEc03 I twisted by ankle while leaving my boss' home.I did not file worker's comp claim because I would have had to get reimbursement on everything out of pocket, and they are late payers.I used my husband's provider for all the services (xray,therapy,doc visits,braces, etc)The company is laying me off due to lack of funding and they'd like to work out a settlement for this injury. I had a few 2nd and 3rd degree tears in my right ankle, I can't wear most of the shoes I own, and it's sore most of the time. What is an ankle ''worth''; what is fair? Can they get in legal trouble for not carrying worker's comp insurance through the US office? thank you.

Yes, businesses that employ people to work in NJ are required to have workers compensation insurance in NJ. Failure to do so can result in a big fine and other penalties. In fact until I look the information up, I have to assume that they really do have workers compensation coverage for you. Regarding how much your ankle claim is worth, it sounds like you have a fairly serious injury. The only way to determine the value of the case is to have you seen by a doctor who specializes in permanent disability claim examinations. It sounds to me like you're being rushed into settling a claim without being properly evaluated. I need more details of the claim, specifically the name and local New Jersey address of the company, as well as your name and address in New Jersey. Just because your company is going out of business does not mean that you will not be able to receive workers compensation benefits.As long as there was coverage by an insurance carrie on the date of accident, the company still being in business or not doesn't matter.
