Legal Question in Workers Comp in New Jersey

As a sole propriater owner operator of a truck, do I have to have workers comp ins.

You should seriously consider organizing your business so that, should you suffer disabling

injury, you will be eligible for workers' compensation benefits, in addition to any entitlement

to social security benefits you may qualify for. You would have to organize yourself so that

a separate business entity operated your truck, employing you as an employee. You should

consult with an insurance professional to learn what the cost of workers' compensation coverage

for you would be under that circumstance.

If you have employees, the law requires that you must have workers' compensation coverage for such employees and provides a penalty if you violate this law.

If you do not have any employees then you do not have to have any workers compensation insurance. If you have even one part time employee, or have other people who do any type of work for you even if you don't consider them to be employees, then you do need workers compensation insurance.
