Legal Question in Workers Comp in New Jersey

Uninsured employer
I was hurt at work Oct.2000. My boss never made out an accident report but he was aware. I never pushed the issue hoping that my injury to neck would get better. I worked with pain every day till one month ago and finally My Doctor put me out of work. I recently learned from the results of my MRI and EMG that I have a pre-existing condition that may have been aggravated by the injury and My Employer refuses to cooperate with me. He will not release his Insurance carrier to me nor is it posted anywhere at work. I reported him non-compliant with NJCRIB.com and they told me he has no insurance and they doubt a one man business would be self-insured. So now, who will pay my medical and will My Boss be Fined when they catch up with him??

If you can document your accident. For example, with hospital records

, office records from your doctor with complaints of an injury at work, there

is a fund in NJ for uninsured employers from which you can

seek a recovery. In addition, your employer is personally responsible

for any judgment you recover. You must file a Claim Petition within

2 years of the date of accident (or last payment of a medical bill) otherwise

you will lose your right to sue.
