employee hit by car,hit & run,can workers comp ins raise my rates.they say they can because experiance modification changed,this was not our fault

They can raise your rates since WC is never about fault. No matter whose fault the incident is, the question is merely one of whether it is in the course of employment. However, the good news is that if your employee is able to recover for his injuries from insurance, then he has to reimburse the WC carrier which in turn helps lower the rates.
