Legal Question in Business Law in New Mexico
We are losing our business due to the economy. There is a clause that says we can not directly or indirectly compete. Is it legal for our daughter, who does not own the business to start the same type of business without our help?

As a franchise attorney, I can say as long as your daughter did not sign the non-compete and you are not involved in her business, she is most likely ok. Of course, it's prudent to show the actual document you signed to legal counsel. Consult with a good business or franchise attorney in your area for specific advice.
