Legal Question in Civil Rights Law in New Mexico
Local Government Problems
I am a city councilor in my hometown and recently raised concerns about the mayor quitclaim deeding city property to himself and his business partner. That upset him after the local newpaper ran the story of my concerns and at the last council meeting (which I was absent from because I was in the hospital) the mayor requested that the council place the item of removing me from office for malfeasance for voicing my concerns and obtaining copies from the county courthouse of the transactions made by the mayor. What I obtained is public record and I don't believe voicing my concerns to my constituents is illegal or wrong and certainly not punishable by removal because the mayor is upset that everyone found out. The council is going along with him because they approved what he did in 1998. I was told by a friend who works for an attorney that just because the council approved what he did doesn't make it legal. Anyway, they want to remove me from office for blowing the whistle on them and I wanted to get the opinion of a professional lawyer on this subject. I believe they are trying to violate my right to freedom of speech. Can you help me with a little direction or your point of view. Thanks for your time.

Definitely consult an attorney who can look at the facts, compile the evidence and file suit on your behalf. I wouldn't wait, because you may need an injunction.
