Legal Question in Civil Rights Law in New Mexico
Can I go get my son from his father if the father and I still have the same custody from when the baby was born? The father took my son from me and won't let me see or have my son.

It is not clear whether or not you and your child's father were married, or if he's named as father on the birth certificate. Both are important. And, if you don't have a court Order defining custody/visitation, you obviously will need one. Contact a divorce attorney in your town. If you don't know any, go to nmstatebar.org and you can find one there. Initial consultations are usually done at no charge, but ask first. This is the only way you can have certainty in these matters, and you should. The courts deal with your problem regularly. Custody/visitation/support are all matters the court can help you with.
