Legal Question in Civil Rights Law in New Mexico
Terms of return to school after expulsion.
To whom it may concern:
Recently I was expelled from my high-school for possesion of a deadly weapon, after a hearing with the superintendent I was allowed to return to school provided i met a list of conditions. The list was as follows
1. Attend Counseling
2. For a period of one year continue active involvement in a Boy Scout Troop
4. Attend a minimum of three sessions of a local drug court.
If i do not meet these terms an expulsion for a periond of one year will immediately take effect.
I will glady comply to all the terms except remaining in the boy scout troop, my question being can the superintendent legally require me to remain in the boy scout troop? Your response would be greatly appreciated.

If it were that simple question, the answer would be no, your principal could not require you to join the Boy Scouts. This situation is not about legal rights. You empowered your principal, when you brought a weapon to school. He is giving you the opportunity to show him that you have made a mature committment to responsible, mature, behavior. How he goes about that is in his discretion. Assuming he had the ability to expell you from the school.
