Legal Question in Civil Rights Law in New Mexico

I need to know if my xhusband co signed for a car for me and i'm not able to pay for it anymore if i turn it into the loan place can he take me to court? He said he will take me to court for messing up his credit. I even told him he could come get it and try doing what ever he wants with it,

He can take you to court for any expenses he incurs because of your failure to pay the loan.
