Legal Question in Technology Law in New Mexico

If my previous employer refused to pay (by law) my over time and is currently paying my unemployment insurance whereas is further awaiting trial before the state as to his neglecting legal over time to me while employed; I own a domain name that he wants to posses however, I'm not looking to sell ownership but just merely retrieve all my over time pay therefore, is it appropriate by law to simply deal to him that if he pays his debt in over time owed to me in full then I will generously transfer ownership of such domain name?

NOTE: His lawyer is asking me for an offer on this domain name however, I have know contract or agreement with the interested party over this domain name. I just merely discovered a name that is appealing in all it's advertising.

Settlement is always advisable in any civil litigation. There is nothing wrong in settling the dispute with your employer in the manner you suggest, although if you dismiss the lawsuit and he doesn't pay after that, you may have a problem. Also, if there is a government agency such as the labor board involved, you will need to coordinate with them and get their permission to enter such a settlement. You may want to enter into a stipulated Judgment with the employer which will remain in effect until you are paid, then be dismissed. Whatever you do should be clearly in writing.
