Legal Question in Constitutional Law in New Mexico

my neaghbor put up a fence blocking my to my farm animals, when asked him if i could put a gate to get back to animals he said his lawyer advised him to put gate up ,but the road that leads to my prop. dosen't belong to him ,if i open fence and put gate is that a crime!
