Legal Question in Credit and Debt Law in New Mexico

Automobile charge off statute

An automobile charge off appears on my credit report from a previous marriage. The marriage was licensed by the state of Texas. The automobile was purchased in New Mexico. My ex husband was the primary signature on the car note. Even though I was a housewife with no income, I was also asked to sign for the car. The divorce decree indicates that my ex spouse is responsible for all the debts occured prior to our separation. How long does the automobile charge off have to stay on my credit report before I can have it removed?

Thank you.

Re: Automobile charge off statute

You can write, at any time, the major credit reporting agencies and explain the situation to them, requesting the charge off be removed from your credit report. Even if they will not do so, they will have to furnish your explanation to any credit inquiry.

Generally records such as charge offs stay on a credit report 7 years.
