Legal Question in Credit and Debt Law in New Mexico
Debt collection and our rights.
We are deeply in debt and are making small payments on our medical bills. The hospital is threatening to turn it over to a collection agency. Can the hospital legally turn our debt over to a collection agency even though we are making payments to show our good faith? Can either of them garnish our wages? Is there anything we can do to protect our rights? Do we actually have any rights?

Re: Debt collection and our rights.
The hospital is entitled to payment by the due date on the bill. If you don't pay, in full, they can send it to collections and sue you. Upon getting a judgment, they can garnish your wages or property. You should speak with an experienced bankruptcy lawyer about your situation.
