Legal Question in Credit and Debt Law in New Mexico

fraudulent use of my drivers license and social security number

I have been sent collections information about a contract that I never signed with a local fitness center. I tried to dispute it with the debt collector but they have an affidavit from the company stating my identification information. Someone has used my name and social security number to open the account. The debt collector informed me that the affidavit stating my identification information is enough to still collect from me even though I did not open this account. What can I do to prove it was not me?

Re: fraudulent use of my drivers license and social security number

I suggest you consult with local legal counsel. I advise you to report this incident to the police to investigate and inform the debt collector of that fact. You are in a difficult situation and the debt collector should not proceed until the police investigation is completed. This recommendation is practical and you should obtain the opinion of a local attorney for further advice.
