Legal Question in Criminal Law in New Mexico
brother sent back to mexico
My brother was sent back to Mexico when he was 16 because of stabbing a man in self-defense, my brother was an illegal imigrant who came to the U.S. when he was 10, so, he was sent and released in Mexico. He is now 19. If he were to come back illegaly, and would have an arrest, would he be sent back again or recieve his original sentence before being sent out.

He would be sentenced under the Sentencing Guidelines and his sentence for illegal re-entry would be enhanced because of his prior conviction. He may not have to serve his entire original sentence, but he will most certainly do some time and then be deported, again. The penalty goes up with each successive offense.
