Legal Question in Criminal Law in New Mexico
Criminal or Civil?
My daughter's roommate had her boyfriend's car parked in the driveway or our home. The boyfriend left town and the girlfriend (the roommate) decided to move back home to another state. The girlfriend says she tried contacting him to let him know that she was leaving, but he didn't return the calls. Well, when the roommate left she said that my daughter could do what she wanted to with the car, so she sold it. The police are investigating it as a stolen car. Is my daughter in trouble criminally?

Re: Criminal or Civil?
Perhaps. She sold property which did not belong to her without the permission of the owner. The larger problem could concern the title. Very difficult to sell a car without a title. If she forged the title in order to sell the car, then yes, she is in criminal trouble. Consult a criminal defense lawyer with all the facts before she makes any statements to the police.
