Legal Question in Criminal Law in New Mexico
My daughter has been charged with a felony 4th degree for having ectasy in her purse when stopped while driving slightly over the speed limit. First offense. She had an arraignment and now is waiting to hear from the Court. She has a 60 day rule date of 8/9/10. What happens if we do not hear from the Court by 8/9/10?

Nothing. There is no more 60 day rule in NM, and the previous rule was subject to so many exceptions that it is essentially of no help. You will probably receive a pretrial or trial setting within about 30 days.
