Legal Question in Criminal Law in New Mexico
Defer Dismiss sentence
I just wanted to know if a defer dismiss sentence would show up on my background check if i am applying with a school system. I am a new teacher and this is my first time applying with this school district. Should I disclose this information in my application?

Re: Defer Dismiss sentence
Upon proper application, a "deferred sentence" successfully completed probation case will be dismissed, and there will be no criminal record. There will always be an arrest record, however, and a court record of the original charge. Anyone researching the public court records of NM will find the dismissed case.
