Legal Question in Criminal Law in New Mexico

Falsely Accuesed of Hit & Run Accident

I was called by police and told that my license # and vehicle was described at the scene of an accident. The alledged incident happened two weeks prior on a Monday morning. I told the officer this was a mistake as I was at work and have a time-card to prove it. The car in question was at home parked in the garage. I told him to come look at the car and see for himself that there was no damage. He never came. I also asked why they waited 2 weeks to call. I received Certified letter from a local attorney representing a person who states that my vehicle was involved in an accident and fled the scene without showing proof of ID and insurance. It said I should contact them within 5 days with my insurance information or the case would be pursued in full-force! What do I do?

Contact your insurance agent immediately. Give him a copy of the letter you refer to [be sure to keep the original in your file] and give him a written statement outlining the facts of your post [also keep a copy of this]. Let them deal with it from there.

It is vital that you keep a copy of EVERYTHING on paper that is involved in this matter, including your time card.

This is why you pay insurance premiums, so the company will take care of problems such as this.

Obviously someone has made a mistake, but don't make a bigger one by ignoring this.
