Legal Question in Criminal Law in New Mexico
I had let my friend stay at my apartment a few months on the condition he pay for his utilities and move out on july 15th, 2010. Come july 17th some of his things were still in my apartment, which has my name on the lease but not his, and I told him he had 2 get everything out by 6PM, which he didn't and as he did not pick up his stuff and he does not intend to pay for the utilities, I am holding on to his fridge, his tv, and a food processor. Could he press charges against me for theft?

The facts you describe do not amount to a criminal act, but rather a civil matter. Theft is criminal, not civil, so you are unlikely to be charged with a crime.
