Legal Question in Criminal Law in New Mexico
Habitual Criminal
I need the definition of Habitual Criminal for the State of New Mexico. I am told it can be placed on a person for ANY third felony conviction. The kicker is...if convicted it is the 1st felony conviction in New Mexico. The other two are in Washington State. Any information regarding this issue is greatly appreciated. Thank you!!

Actually, there is habitual criminal sentencing exposure for the 2nd felony in NM. 1 year. And, it goes up after that. Felonies from other states are counted in the criminal history calculations if they are less than 10 years old.
