Legal Question in Criminal Law in New Mexico

Can something on my record be removed?

Five years ago I went to court on an embezzelment charge. (under $250.) I am currently employed however I am looking at making a career move. Every time I get further into the interviewing process, something happens and I don't hear from the employer. I am wondering if this embezzelment charge is on my record permanently and if so, is there any way of getting it removed?

Re: Can something on my record be removed?

Your message does not state whether you were convicted of the embezzlement charge, only that you "went to court." The result of the case has bearing on what weight it might carry with respect to a background check.

An adult criminal conviction stays on one's record forever. It can be removed only by a pardon by the Governor or, in some limited drug cases, by the Court. Not an easy task.
