Legal Question in Criminal Law in New Mexico

Selling magazine subscriptions without a permit

I went to jail overnight in Alamagordo, NM for selling magazine subscriptions without a permit back in 97 or 98. Also I got into trouble for same reason in Fort Dix New Jersey (no jail) and Brown Deer, WI no jail same year. Are these misdeamenors? Do I have to mention them on background checks?

Re: Selling magazine subscriptions without a permit

It's a misdemeanor in Colorado, and likely in those other states, too. If you are asked to report misdemeanor convictions on an employment application and do not report these, you risk disqualification for dishonesty.

In my opinion the dishonesty would rank far higher as a negative than the fact that you sold magazines without a permit. I'm guessing you were a student, or student-age, at the time, and mixed up with one of the many phony magazine subscription gangs around. If so, you had a horrible experience and would likely find sympathy, rather than condemnation, for your mistake. The people who run the gangs are the people employers prefer to avoid.

Good luck.
