Legal Question in Criminal Law in New Mexico
Son caught stealing from employer
My 19 year old son has been suspended (with pay) from his employer while an investigation is conducted. They will not tell him anything other than ''investigation''. He has admitted to me that he used a company gas credit card to charge gas for his personal vehicle (many times). I also believe he may have stolen many other items from the store.
How likely is it that he will do jail time if the company decides to pursue and what is the dollar amount to determine a misdemeanor versus a felony (or is it all a felony)?

Re: Son caught stealing from employer
If the value is more than $250 the crime of theft is a felony. Whether or not upon conviction a term of incarceration would be given depends upon many things, most of all his prior criminal history.
