Legal Question in Criminal Law in New Mexico

Statute of Limitations

In 1990 me and my brother ripped off an employee. He got mad and threatened to go to the police. We beat him up. We called the cops and said he was trying to rob us. he ended up convicted of a couple of felonies. right now this guy is going to remove the case to federal court. Can we be still charged for perjury and setting this guy up?

Re: Statute of Limitations

Your post is confusing because it is not possible for a criminal defendant to "remove his case to federal court." Only civil cases can be so removed, and then only under specific circumstances.

But the gist of your question involves your liability for perjury and false prosecution. That liability remains with you for many years.

You have caused an innocent human being grave problems with the criminal justice system. The longer you permit this injustice to remain the more culpable you become. Why not come forward and rectify the wrong you have done. That is the right thing to do.
