I would like to what the statute of limitatons is for credit card fraud in the state of New Mexico. Would it differ from state to state? I know very little about the law, so if anyone could help me answer this question, I would appreciate it.

Re: Statute of limitations for credit card fraud

Depending upon how you are charged, it may be a 3rd or 4th degree felony, and prosecution must be commenced within 5 years from the time the crime was committed.

For a 2nd degree felony it is 6 years; for a misdemeanor it is 2 years.
