Legal Question in Elder Law in New Mexico
Power of Attorney Name Change
I am my father's POA. I recently changed my name following marriage. He is no longer competent to do a new POA. Is the current POA valid despite my name change?

Re: Power of Attorney Name Change
Yes. If it is not too old (some banks won't honor one more than one year old) it is still legally good if it is a durable POA which survives the incompetency of the maker. You may have to sign it twice, once in the name printed on it, and again with your new name, e.g., Jane D. Doe, now Jane Doe Everywoman.
