Legal Question in Family Law in New Mexico

0I live in CA the case is in NM. The back child support is affecting my DL in Ca. The mother was going to sign a affidavit and agree to the back child support and then backed out of it. I had a case for the support and the mother continued 2 times and the support division continued it once. The last thing that was said is that they couldn't give me a court date because of the lack of judges they had. I eventually received a letter saying that the cases was discontinued because I didn't respond to something that they sent. If I agree to the back support to fix the problem with my DL can I still fight the back child support afterwards?

It appears you are negotiating with the Child Support Enforcement Division. Assuming this is true, I suggest you make telephone contact with the attorney on the case and work it out, or hire an attorney in New Mexico to negotiate for you.

You seem to be misinterpreting some things: A shortage of judges means a later court date, not no court date; and the case is not discontinued if you fail to respond to a pleading, but you may be subject to a default judgment.

If you make a deal on back child support to get your license back you will not be able to fight it later. That's what the deal is.
